Does anyone have experience of TUPE?

Has anyone been TUPE�d across to another company and after 90 days their contracts were changed and continuity of service loss?

I am working for a company which is shortly going to contract out some of the staff, myself being one of them. I have been with the company for 14 years.

just had a word with a friend who was TUPE,d just last year he says its a regulation so you keep the same terms of agreement you had with your previous employer, I must admit i had never heard of it before my friend told me about it just the other night...

If you're TUPE'd across then you don't lose service at all, that's for certain (this assumes you're permanent staff rather than fixed contract). Have been through this before as has OH. After a year they can change your terms and conditions but am pretty sure they can't prior to that. You normally win some things and lose others eg I once lost flexi but gained more pay as I was paid for a longer week which I was already working. Have you been told that this is what will happen or is it just speculation?

I work as a cleaner as well as the day job, and my boss has just had a contract stopped but the girls doing it want to go with the company taking over the job and she was saying something about TUPE, but as I had no clue what she was on about I just nodded.
I hope it gets resolved satisfactorily, whatever it is.

I hadn't heard of the term TUPE before but i am going on a secondment from my post at one school to another and all my pay etc stays the same but my job role changes as it is a different post. Hope you are able to sort your contract etc out,uncertainty isn't nice.

The company taking over the contract is obliged to offer you the same job on terms that are "no less favourable" than what you're on at the moment. If they don't then it's hello employment tribunal and look forward to a very large cheque!

My son was tupe'd and he stayed exactly as before, even the hours, which were lower than the workers of the firm he was tupe'd to. He was also on more money than some of the others. As far as i'm aware, this cannot change for one year.

I have TUPEd three times.

Local government to private IT firm.
Different private IT firm.
Back to local Government.

Now have twenty three years continuous service, but biggest actual was fifteen years.
