I've not had this problem, but you will find a lot of buyers leave feedback as soon as they receive an item, without waiting to try it, hence the good feedback. Not everyone realises you can go and add another comment or reply to feedback. Not all parts of the eBay system are easy to navigate round, and some people just can't be bothered to go through the complaints system because it is very long-winded.

As Kernowyon said, if you paid by PayPal you'll be ok (also certain credit cards, I believe). You can ask PayPal to refund your money as well as trying eBay's own complaints system.

            Good luck.

I believe you need to file an item 'not as described' claim and send it back - tracked - so that you have proof of delivery....before paypal will get your cash back for you.

On the moneysavingexpert forum, there's an ebay board, and there's experts on the procedure there, have a trawl through some threads to get an idea of how best to go about it.

I've stopped leaving feedback until I'm 100% happy.

I've been a seller and buyer on eBay for many years, I have never had any problems at all - I guess I have just been lucky.

Try to talk to your seller before getting too angry, there may be an explanation - if not, then report him/her to eBay. It is, in the main, an excellent forum/market.

                  Hope you get it sorted

You don't need to return the item - Paypal usually finds in favour of the Buyer in disputes.

Do not send the item back.

If it is a fake, then you have a good lever, as you could report them for copyright infringement. Your local Trading Standards would pass it onto the area where the seller is and they would take action.

I had this problem years ago where I sold some of my goods to a person who started to make copies of my design, luckily they were covered by copyright and the items I sold were even marked with the copyright.

Trading Standards took him to court and had an order placed on him.

The original games manufactures are fairly quick to take up piracy cases as well and will quite happily check the game for you to authenticate it or take action.

That could be a heavy incentive for the seller to want to settle with you PDQ.
I am certain that the day my boat comes in, I'll be at the airport.

is he in this country? It lets ebay down when this happens....how long since you bought the item? find the transaction id in paypal, you will need this when making a claim, it can take about 30 days for them to retrieve the money. Keep all emails sent and received, incase they want to see them.

Good luck if you need any help pm me xx

                            Just a thought...

Are you emailing, or using eBay's message system? Their messages don't always reach their destination, and if they do, it's often days later that when they were sent. I have had this happen to me, and then three messages all appear at once. Usually long after the event!

That's actually about my only gripe with eBay - their message system is carp!
