  • repossesion?

    Hi,

    just got a letter through saying that '.... HEREBY GIVE NOTICE THAT THE ABOVE MENTIONED PLOT HAS BEEN REPOSSESSED DUE TO NON PAYMENT OF RENT'

    I was told when I signed up that I would be sent a bill through the post. I never received one, I just assumed that the billing month hadn't come yet? No one told me that I'd have to go in and pay or phone and ask where the bill is!! Liked I'd put so much effort and money into it if I had no intention of paying!

    They've dated it as the 26th, I only got it today and too late to call them to sort it out!

    I'm so angry, we've put lots of effort into our plots and have lots of things cropping over the next few months

    Can they do that? Does it mean they intend to repossess if I don't pay up? Or that they have already? Can they do that without warning me? I'm so disappointed and stuck in limbo for the whole weekend

    When did you sign up Chrissie? Is the allotment owned by the local council, or an allotment association? Write them a letter, stating what you've told us. I'm pretty sure that they have to write asking for payment (or send you an invoice). Then send a reminder, then send notice of intention to repossess. Legally I'm sure they can't go straight to the letter that says your lottie has been repossessed. Get on the phone Monday, and meantime compose that letter, and send it by recorded delivery. Good Luck.

          Not good news for you- but fight it....crazy how other sites leave plots neglected for up to 4 years and no further action...
          Royal Mail is certainly not as reliable as it used to be is it?????
          I wonder where your first cheque ended up?????

                I'm sure if you just pay what is due there will be no problem Chrissie. But shame you have to go through the worry of it.

                  I signed up back in May and assumed that I would have a bill sent in October as the new rent is due on the first of November. They are ment to send out an invoice, no idea when they should have sent it with me as I signed up half way through the year.

                  It is owned by the local council.


                  I went first thing this morning to see the site agent while he opened up the toilets and he said not to worry, it has happened before and if I have any problems to ring him and he'll sort it out

                  Will be going in first thing monday morning to pay and sort out next years too, just in case I get missed off again!

                  Feel better for going and talking to him, will feel a lot better come monday morning when it gets sorted properly.

                      yes, that's true There is a big waiting list for plots in the whole area, I was really lucky to get mine. It's a well manged site, apart from the billing system (good old computer system!)

                      A few who took theirs on at the same time as me have done nothing or very little and we've worked our butts off and have had a really good first year (with many thanks owed to this site! ) I'd imagine if anyone gets funny about the bill, that will go in my favour

                        Sorry to hear this. Isnt it always the case that you recieve a nasty letter on a saturday morning and have to spend all weekend stewing over it. We had out internet cut off on a saturday morning, mistakenly i rush to add. On phoning them they told me i could not be reconected till Monday. So obviously who switched it off on the saturday morning could not then switch it back on...................Anyway rant over.

                          They will probably say it's a computer error. However I work with computers, and they only do what the operators tell them to do, therefore it is an operator error. Our local council is terrible, it's not the fault of the people who work there it's the pressure they are under because the council is not meeting it's targets. Down to management at the highest levels, and it's really not fair that the people on the "front line" are taking the flak.
