Asbestos sheeting

    Asbestos sheeting

    Hi my allotment is council owned comittee run
    I am in my second year of havingban allotment and the shed that is on my plot was a home made effort and i want to remove it and put a decent one on the plot
    However i have noticed that one to two sides of this have what appear to be asbestos sheeting
    My question is who is responsible for its removal
    Myself ,comittee or the council
    The committe are responsible in my book for all aspectsof health and safety
    But knowing my luck it will be down to me
    Anyone know who has the responsibility of removing it

    The duty to manage asbestos is a legal requirement under the Control of Asbestos Regulations 2012 (Regulation 4). It applies to the owners and occupiers of commercial premises (such as shops, offices, industrial units etc) who have responsibility for maintenance and repair activities. In addition to these responsibilities, they also have a duty to assess the presence and condition of any asbestos-containing materials. If asbestos is present, or is presumed to be present, then it must be managed appropriately. The duty also applies to the shared parts of some domestic premises.

    The above was taken from the HSE web site, it primarily concerns places of work, but I would contact your council and the committee and get advice.

      Contacting your committee seems the best bet to start with.
      However, assuming the asbestos is not damaged or otherwise dangerous at the moment, seeing as you are the one who wants to remove the shed, I feel like it may end up being your responsibility to dispose of it.

        Not going to be paying thats for sure they should have made the shed good before passing it on or at least made me aware if they dont sort it I will be leaving it and just build another shed and lose a little bit of my plot
        Ive spoke to another holder who also had asbestos he removed it from his plot and dumped in in the committee compound
        I will see what they say but i aint funding any removal thats for sure

          Pretty sure that if you remove the asbestos then you would become liable for it. I would have thought your plot neighbour could be prosecuted if someone felt like it!

            Our local tip in Crewe will take asbestos sheets free of charge as long as it is double wrapped in strong polythene. If the sheets can be separated easily and transported, you may be able to dispose of them similarly.
