  • Allotment AGM

Our AGM was on saturday night more people there than usual due to new people taken on allotments, waiting list down to 60 as they have taken anyone off who lives outside the boundry, also split large plots up. Late payers will now get a £10 fine, rents due in oct and some have only just paid.
Not a lot else was said really.

We still haven't had ours! It was supposed to be in January, and we're supposed to pay our rent then too. My rent money is still smouldering a hole in the back of my purse as I haven't seen the treasurer either of the times I've managed to get to the plot!

You have some very lucky plotholders, our AGM is the second week in January the bills are sent out for the rent from the begining of December if you have not paid your rent by or at the AGM it is taken you do not want to renew you are given two weeks to clear your stuff of the plot and it is put up to be let.

Wish ours would do that they pussy foot around and say its the rules and also they cant kick anyone off from April till Sept. even if they have had notice to quit. You have to pay by cheque not sure if you can pay by cash ( not allowed to give it to site manager )but they can only bank so many cheques at once.and they will not set up dd payments. Arguments every year about getting people off quicker.

I found the Agm Minuets from last year It says ' Allotment law does not allow for immediate eviction on unused plots and there is a process that must be followed. A lapse in Cultivation letter is issued, if no response a letter asking if the member intends to continue is sent, if they say they are going to and fail to cultivate a 'Notice to quit ' is issued, this can only be done between the months of September to April and members have 12 months under the law before they have to give up their plot'.
No wonder it takes so long to get people off an uncultivated plot.

            These are our rules
            CONTRAVENTION OF ASSOCIATION RULES

            A. Given due regard to the personal circumstances of a plot tenant, the committee may require an absent or non-complying tenant, to vacate the plot and terminate their tenancy. The committee shall satisfy the Chairman, or Vice Chairman, that this action is unavoidable. Following this, the plot will be re-let.
            B. The Secretary shall write, by ordinary first class post, to the last known address of the tenant, requiring the tenant to take immediate action and/or meet with the Chairman or Vice Chairman, to resolve the problem, within a period of 14 days. In the event of an unsatisfactory response, this shall be followed by a 14 days “Notice of Termination of Tenancy”, in writing, sent by first class post to the tenant.
            C. Any meeting, taking place at any time of year, between the Chairman, Vice Chairman, and a tenant, shall take place at the Site Office. The Site Manager may be present if either party so request, as an independent witness. A tenant with a record of “good cultivation” will not be evicted as a result of temporary absence due to ill health or having to work away from home or similar reasons. However, a tenant at his or her earliest opportunity must inform the Site Manager of his or her extended absence and arrange for suitable action to prevent a plot becoming overgrown.
            D. The Chairman or Vice Chairman shall create an “appeal” route for disputes, as B Borough Council is no longer concerned with site management. The “appeal” route may delay or withhold enforcement, if it is considered that by so doing, a tenant will resume cultivation of the plot.
            E. If at the end of October, the committee has decided that a plot has been abandoned, the Secretary will send a letter advising of termination of tenancy, as of 31st December of that year. This notice of termination of tenancy will replace the Renewal Notice and invitation to attend the Annual General Meeting of the association. Following this the plot will be re-let.

The decision of the Chairman, or Vice Chairman will be final. There will not be any reimbursements.
