  • Rules allowing Chickens to be kept in a rented property

    Hiya

Someone sent me a Private Message regarding legislation about keeping chooks in a rented house. I unfortunately deleted the PM, and i cant remember who sent it, but i will include the link below.

The upshot is that by using the Allotment Act 1950, it overturns any subsequent covenant or law to the contrary and allows you to keep poultry and hens on any land that you use as if it were your own - i.e the garden of your rented home is such a piece of land.

You are allowed to erect whatever buildings etc that may be required to care for animals as well. the only downside is that the poultry or rabbits can not be seen to be causing a nusiance - either noise, odour or vermin, and you cant use the poultry as a business.

The Poultry Guide - Hens on Allotments in the UK

    the relevant section is here

    12. --(1) Notwithstanding any provision to the contrary in any lease or tenancy or in any covenant, contract or undertaking relating to the use to be made of any land, it shall be lawful for the occupier of any land to keep, otherwise than by way of trade or business, hens or rabbits in any place on the land and to erect or place and maintain such buildings or structures on the land as are reasonably necessary for that purpose: Provided that nothing in this subsection shall authorise any hens or rabbits to be kept in such a place or in such a manner as to be prejudicial to health or a nuisance or affect the operation of any enactment.

    Hope this helps

    Mike
