  • Unfair terms in consumer contracts regulations 1999

For those of you facing large increases bear in mind that terms in your leasing agreement which have the object or effect of enabling the seller or supplier to alter the terms of the contract unilaterally without a valid reason which is specified in the contract; are included in a list of
INDICATIVE AND NON-EXHAUSTIVE LIST OF TERMS WHICH MAY BE REGARDED AS UNFAIRas detailed in Schedule 2(1 )(j) of the act which can be seen here
    http://www.legislation.gov.uk/uksi/1...chedule/2/made.

An unfair term is not binding on a consumer in terms of Regulation 8(1)

For the avoidance of doubt a landlord(including a local authority landlord) is a supplier and a tenant a consumer for the purposes of the regulations. The guidance notes to the regulations can be seen here. http://www.oft.gov.uk/shared_oft/rep...rms/oft356.pdf.

Excuse the different fonts above. I copied from the regulations and left the fonts as they were.
