  • Nerve-wracking Morning

    This morning the BH and I had to go to the Independent Tribunal for the BH's Mobility Allowance.

    Fourteen years ago the BH fell and damaged his spine. He fractured several vertebrae and ruptured a disc in his lower spine. He had chemoneucleosis, followed by a bungled operation and, to cut a long story short, now has three degenerating discs in the lower spine, sciatica and chronic back pain. He walks only a few yards at a time and can't do very much physically at all.

    His condition is considered stable, but chronic. It will never improve. The DWP decided he was better and that he no longer required his Mobility car to get to work, hospital etc. So we appealed their decision and had to go as far as it is possible to go with the appeals procedure. Today was our final hearing. We've been waiting for this date since last July, dreading it, dreading the BH ending up housebound and completely dependent on me. Without the car he would have had to resign from his job and give up being Chair of Governors at school as he would have been unable to get to either place.

    So this morning we met the panel, a judge, a doctor and a disability expert, answered loads of questions to the best of our ability and we won. We are delighted, relieved and exhausted. My poor BH now feels that he might be vindicated, as he has been made to feel like a - struggling to find the right word here - criminal (almost) for claiming this benefit. I know there are a lot of people who do claim when they shouldn't and who abuse the system and, as a result, everyone else is tarred with their brush and that's very unfair.

    We've celebrated with a cup of tea and piece of caramel shortbread!

        Excellent news Jules, well done for sticking with it!
        I've got 2 knackered discs, and one that pops out when it feels like it. I had 18 months/2 years of horrendous pain with it a few years ago and had to fight for a long time to get the DLA/mobility allowance. Even with a close relative who worked for CAB helping to word the appeal in the sort of language that they pay attention to, it was still a struggle. And yep, they make you feel like lying, cheating scum in the way they deal with you
        Thankfully I managed to get mine (back pain) under control with some help from my hypermobility specialist, avoided surgery, and was able to stop claiming DLA

          Those were the words I was looking for - lying, cheating scum! Sadly, for the BH, it's too late, but I swear that, when it first happened, if he'd been able to continue with the chiropractic sessions then he wouldn't have needed the Chemo-neucleosis or the bungled fusion op. Interestingly, they don't offer the Chemoneucleosis any more because it kills people if the acid gets near the spinal cord, so we were very lucky there!

          I was upset and frustrated that the DWP would rather have had the BH housebound (and on full benefits) than help him stay at work and remain an active participant in community. It gets to me that there are people out there who desperately need this help but are stymied at the first hurdle by reams of paperwork and bureaucracy. Er....anyone know where this soapbox came from?!

            What is chemo-nucleosis? I had a weird thing done when I was 16 and my first prolapse happened; they injected some enzyme or other extracted from pineapple, or papaya () into the disc. Was supposed to cause it to shrink back. In fact it ruined the structure of the disc altogether They apparently don't do that any more...

            Edit: Just googled, and they are one and the same. My hypermobility professor told me they don't do that procedure now?

                  Strange isn't it that the members of the panel didn't have to "jump through hoops" to qualify for their big fat salaries ! ! ! Congratulations. Cheers, Tony.

                        Sarz, they stopped doing it because, more often than not, the procedure was carried out when there were tears in the disc and the acid then leaked into the spinal cord causing almost instant paralysis, brain damage or, in some cases, death. The BH was lucky and got away with 'minor grazing' of the meringue tissues which left him in agony in hospital for 3 months and me at home with three children and an imminent new baby. Sam arrived when the BH was still in hospital and he didn't see him for the first 6 weeks.

                        Thankfully this wasn't the ATOS er....people. They are completely independent of the DWP.

                        Thanks NP. The panel were actually lovely as it turned out, very human, but that didn't stop us from bricking it before we went in to meet them. Every person we met there was really nice and friendly, incredibly helpful.

                          Congratulations Jules and Co! A well deserved victory for common sense -albeit a protracted affair!

                          BTW, - Sarz, What is a Hypermobility Professor and how does one accquire one?
                          Mr Teez has suffered with back and leg pain along with a very unpleasant numbness in one heel for years. Various trips to the doctor and an MRI scan have resulted in, "no obvious abnormalities" and an offer of either prescription pain-killers or anti-depressants. It doesn't stop him from working - he HAS to - but it is very debilitating and retrictive.
                          (sorry for Hijacking....)

                              For "no obvious abnormalities" see 'we haven't got the foggiest and we can't be bothered to look deeper'.

                              I hate that phrase. You know you're going to have to fight for a diagnosis when someone says that to you. Does everything have to be obvious? Is it only going to show up if it's wearing a red bobble hat and shouting Cooeee?! Look for it man, that's what you've been trained for.

                              Sorry, still haven't found out where this soapbox goes....
