    ....of their :>(*&& actions before suing everyone left, right and centre.

    Seriously because some bint in Newcastle decided to sue my OH 2 years after he accidentally dropped his motor bike on her car boot (which she said was fine, not a problem) because she stuck her car into reverse without looking, he now has a ccj against him (thats how the slimy solictors get their money, by issing a ccj order) we can't get the house we wanted to rent.

    We are now looking at another cold, expensive and chilblain inducing winter in this hovel of a house.

    I hope she put her money to good use.

        You'd think not but apparently it's perfectly legal to issue ccj's against pple if you want money from them. People and companies do it all the time. We was told by the insurance company not to do anything and they would handle it all.

        Good job!! NOT!!!

        So we have 2 options:

        1 - we apply to show it as settled (£15 settlement insertion fee) but stays on file for 6 years (oh yeah baby)
        2 - we try to get the decision set aside by a new judge (£75 fee and not necessarily going to change)

          Don't those adverts prey on peeps who've had an accident in the last five or ten years(or however many?)
          Sounds like she suddenly needed to earn herself a penny or several,probably sat watching a bit of telly & decided on doing it the easy way!
          I hate pointless sueing...fair enough if you NEED the money & the accident has prevented you from earning it...but to make a bob or two I think it's just plain wrong and sorry,but if she's managed for two years,why now other than greed!?
          People moan about how pathetic Health & Safety regs are...well tis thanks to peeps that sue for the slightest thing!

          Can't help you get the house you want but can sympathise with cold wet damp winters in crap houses!Although we're in a far better one now(& paying for it!),we had several in a house with crap heating,windows that didn't actually shut properly & damp creeping up the walls,definately didn't enjoy it,but we survived...you'll get there Lovely!!!{{{{{x}}}}

            Well I suspect she has no idea of the on going consequences from the court case - it's the slimy, nasty blo*d sucking solicitors that know better I'm furious at. They know the damage they're causing.

              Forgive my ignorance, but how do you accidentally drop a motorcycle onto a car boot ?
              If she reversed into him and admitted such, how has he come out of this as the guilty party ?

                If she's taken it to court in his absence, who knows what she's told the judge!

                  Jings, what's a CCJ ? Will she not just settle if you pay for the damage to her car ?

                      Just a thought Lizzy.
                      Is the house you were looking at through an agency?Would they change their mind if you could get a guarantor(sc...bl&&dy wine!)...the last house we rented was through an agency,our rather poor credit ratings meant they said no,but changed their minds when Daddy Dear signed as Guarantor.

                        I think it was something to do with them both reversing (bike reverse = push it backwards) in the road at the same time due to a road blockage. OH was across the roadin the middle of a walking u-turn with bike between him and the car. She reversed towards him really quickly, it startled him and the bike lost balance (brand new with full tank of petrol) and fell into the car so technically his bike hit her car. Apparently the reason for dropping the bike wasn't provable.

                          It's a County Court Judgement. So when someone says you owe them money this is what they apply for in court. They submit the initial request and a judge then rules either way but you have to settle it if it's found against you.

                          There was no damage to her car - they both walked away from the 'incident' that day after swapping details and her saying no problem, it was a wreck of a car anyway. OHs brand new bike needed £1500 repairs to the fairing and tank which he paid for privately.

                          2 years later a solicitor issues a CCJ, it goes against us, we PAY up via the insurance company but it is a big black mark in our credit rating regardsless, but just to make matters really good, it's marked as unsettled and so 4 years later, we loose a new home.
